Calendar AiML

Calendar AiML is a product of Whisper AiML Inc. These Terms of Service explain the rules for using the Calendar AiML website, applications, and related services.
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who We Are
Calendar AiML is a scheduling and calendar productivity platform that helps users manage availability, bookings, calendar synchronization, and related scheduling workflows.

In these Terms, “Calendar AiML,” “we,” “our,” and “us” refer to Whisper AiML Inc. “You” refers to the person or entity using the Service.
2. Eligibility
You must be at least 18 years old and able to enter into a legally binding agreement to use the Service.
If you use the Service on behalf of a business or other organization, you represent that you have authority to bind that organization to these Terms.
3. The Service
Calendar AiML provides tools for calendar-based scheduling and related workflow features. These may include:
- account creation and authentication
- calendar connection and synchronization
- booking and availability management
- event creation, editing, and cancellation
- scheduling automations and related productivity features
We may update, improve, remove, or modify features from time to time.
4. Accounts
You may need to create an account to use some or all features of the Service.
You agree to:
- provide accurate and complete information
- keep your login credentials secure
- promptly update your information if it changes
- accept responsibility for activity that occurs under your account
You must notify us immediately if you believe your account has been accessed without authorization.
5. Connected Accounts and Third-Party Services
The Service may allow you to connect third-party services, including calendar providers and authentication services such as Google.
By connecting a third-party account, you authorize us to access and use the information and permissions you grant solely to operate and improve the Service as described in our Privacy Policy.
Your use of any third-party service is also subject to that provider's own terms and policies. We are not responsible for third-party services or their availability, actions, or data practices.
6. Acceptable Use
You agree not to:
- use the Service for unlawful, fraudulent, deceptive, or misleading purposes
- interfere with or disrupt the Service or its infrastructure
- attempt to gain unauthorized access to accounts, systems, or data
- scrape, reverse engineer, copy, resell, or exploit the Service except as allowed by law
- upload or transmit malware, harmful code, or abusive content
- use the Service to spam, harass, or impersonate any person or entity
- misuse integrations or connected calendar data
- access the Service in a way that could damage, disable, or overburden it
We may suspend or terminate access if we believe you violated these Terms or are using the Service in a harmful or abusive way.
7. User Content and Data
You may provide information, text, calendar details, booking information, and other content through the Service (“User Content”).
You retain ownership of your User Content. You grant us a limited, non-exclusive, worldwide license to host, use, process, reproduce, and display your User Content only as necessary to provide, maintain, secure, and improve the Service, and as otherwise described in our Privacy Policy.
You represent that:
- you have the rights necessary to provide your User Content
- your User Content does not violate any law or third-party rights
- your use of the Service does not violate any agreement you have with a third party
8. Privacy
Your use of the Service is also governed by our Privacy Policy.
Our Privacy Policy explains how we collect, use, store, and disclose information, including information from connected calendar providers and authentication services.
9. Google Data and Limited Use
If you connect Google services to Calendar AiML, you acknowledge that we may access and use Google user data only for the purposes necessary to provide the features you request.
We do not use Google Workspace data for advertising. We do not sell Google Workspace data. We do not use Google Workspace data to train generalized artificial intelligence or machine learning models.
Use of information received from Google APIs will adhere to the applicable Google API Services User Data Policy, including the Limited Use requirements.
10. Availability and No Guarantee
We aim to provide a reliable Service, but we do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.
Scheduling and calendar systems can be affected by third-party outages, sync delays, user settings, API limitations, time zone issues, or provider-side errors. You are responsible for reviewing important calendar events and bookings.
11. Fees and Billing
Some parts of the Service may be offered for a fee now or in the future. If paid plans are offered, pricing, billing terms, renewal terms, and cancellation details will be presented to you at the time of purchase.
Unless otherwise stated:
- fees are non-refundable except where required by law
- subscriptions renew automatically until canceled
- you authorize us or our payment processor to charge the applicable fees
We may change pricing prospectively by giving reasonable notice.
12. Intellectual Property
The Service, including its software, design, branding, text, graphics, interfaces, and related content, is owned by Calendar AiML or its licensors and is protected by intellectual property laws.
Except for the limited right to use the Service under these Terms, no rights are granted to you.
You may not use our name, logo, branding, or other protected materials without our prior written consent.
13. Feedback
If you provide suggestions, ideas, or feedback about the Service, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use that feedback for any lawful purpose without compensation to you.
14. Suspension and Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if:
- you violate these Terms
- we suspect fraud, abuse, or security issues
- required by law
- a third-party provider restriction materially affects the Service
- continuing to provide the Service creates legal or operational risk
You may stop using the Service at any time.
Upon termination, provisions that by their nature should survive will remain in effect, including provisions on ownership, disclaimers, limitations of liability, indemnity, and dispute resolution.
15. Disclaimers
The Service is provided “as is” and “as available.”
To the maximum extent permitted by law, Calendar AiML disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade.
We do not guarantee that:
- the Service will meet every requirement or expectation
- bookings will never fail or conflict
- data sync will always be complete or immediate
- the Service will be uninterrupted, timely, secure, or error-free
16. Limitation of Liability
To the maximum extent permitted by law, Calendar AiML and its affiliates, officers, directors, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to the Service or these Terms.
To the maximum extent permitted by law, the total liability of Calendar AiML for any claim arising out of or relating to the Service or these Terms will not exceed the greater of:
- the amount you paid to Calendar AiML for the Service in the 12 months before the event giving rise to the claim, or
- $100 USD
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
17. Indemnification
You agree to defend, indemnify, and hold harmless Calendar AiML and its affiliates, officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:
- your use of the Service
- your User Content
- your violation of these Terms
- your violation of any law or third-party right
18. Changes to the Service or Terms
We may update the Service or these Terms from time to time.
If we make material changes, we may provide notice by posting the updated Terms on our website, updating the effective date, or using other reasonable means. Your continued use of the Service after the updated Terms take effect means you accept the revised Terms.
19. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles.
20. Disputes
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved in the courts located in the jurisdiction in which the operator of Calendar AiML is established, unless applicable law requires otherwise.
If you want, you may first contact us to try to resolve the dispute informally.
21. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
22. Entire Agreement
These Terms, together with the Privacy Policy and any additional terms presented to you for specific features, form the entire agreement between you and Calendar AiML regarding the Service.
